The Supreme Court has approved the development of a mobile application for use by road accident victims, police, road accident compensation courts and insurance companies across India for prompt resolution of compensation claims.
A bench of Judges Sanjay Kishan Kaul and Messrs. Sundresh was recently told that insurance companies are ready and willing to develop a centralized mobile app if the court demands it.
It was told on the bench that a group of tech-savvy young people have developed a platform that can meet the demands of insurance companies and if it needs to be changed by them for their needs, it can also be done.
The application in this regard filed by the General Insurance Corporation sought directions from the court, apparently on the grounds that unless all officials of the state police and accident courts agree to its use and download the file. photo and documents, it would become redundant.
“We really fail to understand why the mobile app could not have been developed and, at best, the instructions obtained from the court to be used by all relevant stakeholders. The development of the mobile application should not have waited for court instructions. it may be, the necessary should be done as soon as possible now and naturally, there would be cooperation of all the stakeholders qua the application thus developed for the use to be effective â€, declared the bench.
Notably, with the development of the app accessible all over India for road accident victims, courts, police and insurance companies, the prompt resolution of compensation cases would soon become a reality.
Acting as amicus curiae, lawyer M Vijayaraghavan, as well as lawyer Vipin Nair, reiterated the need for a transparent mobile app to assess MACT claims on a pan-Indian basis.
Senior lawyer NL Rajah informed the court that a mobile application was being developed by a team from Chennai. The attorney for General Insurance Corporation also informed that the company would be ready and willing to develop a similar mobile app and help in this process.
Noting that groundwork has been done in this regard, the bench said, “We believe arrangements can be made to share this app or platform with all stakeholders and they can respond to it.”
The trial court was considering a brief motion from Bajaj Allianz General Insurance Company Pvt Ltd. He had previously issued a multitude of instructions to facilitate the process of paying compensation to victims of road accidents as well as to expedite cases before the car accident. claims tribunal.
The court also allowed a request for implementation by a representative body of the 24 general insurance companies, the five autonomous health insurance companies, in total 12 reinsurers, including General Insurance Corporation of India, Foreign Reinsurance Braches (FRB) and Lloyds India, and specialist insurers. , incorporated under Section 64C of the Insurance Act, 1938.
