Lenoir County Schools invite attorneys interested in providing legal services. The purpose of this RFP is to select the local Lenoir County Schools Legal Advisor to handle the bail bond and vehicle forfeiture work for the school system.

The work primarily includes reviewing and opposing motions to quash the forfeiture of bonds, reviewing motions to surrender previously paid forfeitures of bonds, and attending district and higher court hearings regarding matters of confiscation of bonds. The work will also include resolving vehicle forfeiture issues in accordance with state law, including reviewing lien holders, innocent owners, and other petitions calling for the release of vehicles subject to forfeiture. Lenoir County Schools are looking for legal counsel effective February 1, 2022.

Sealed proposals for legal counsel are requested by the Lenoir County Board of Education. All proposals must be submitted to Brent Williams, Superintendent of Schools, by 4 p.m. Friday, January 7, 2022.

Nothing herein is intended to exclude a responsible firm or lawyer or to restrict or restrict competition in any way. All responsible firms and lawyers are encouraged to submit proposals.

Lenoir County Schools reserve the right to accept or reject any proposal submitted in the best interest of Lenoir County Schools, and the Board further reserves the right to waive any defect or informality in any proposal. if it is in the best interest of Lenoir County Schools.

Lenoir County Schools intend to enter into a contract with the successful bidder incorporating all of the provisions of the Request for Proposal. By submitting a proposal, the proponent agrees to enter into such a contract if he obtains the work.

Ten (10) copies of all completed Legal Services Proposals MUST be returned to Brent Williams, Superintendent of Schools, Lenoir County Schools, 2017 W. Vernon Avenue, Kinston, NC 28504, by Friday January 7, 2022. Requests Lenoir County Schools that each proposal include the following: a summary page listing all rates, fees and charges.

All tenders submitted until the deadline will be reviewed by schools in Lenoir County. Proposals received after the 4 p.m. deadline will not be considered. The elements that will be taken into consideration are credentials, experience, references and fee schedules.

  1. All services should not be billed more than once per month and should include a detailed description of the item billed, the service provided, the date the service was provided, the time spent, the hourly rate, fees and reimbursable expenses.

  1. The Commission does not pay an hourly rate for secretarial services or other administrative staff. Administrative support is considered part of the overhead costs of the external lawyer and is built into its fee structure. Such administrative support includes the services of word processors, librarians and any IT professional. While it may be appropriate to pay an hourly rate for the services of a paralegal, purely administrative or secretarial duties (i.e. performing them.

All proposals must include the following information in the order requested:

  1. Please submit a brief description and history of your law firm, including date of establishment, number of employees and any specialized services provided.

  1. Please list the members of your company who will be assigned to bail and vehicle forfeiture cases, along with their professional references and resumes.

Minimum skills: The cabinet will appoint at least one lawyer within the cabinet, who will be responsible for representing the interests of schools in Lenoir County on these matters. This person will be licensed to practice law in North Carolina for the duration of the contract and will remain in good standing with the North Carolina State Supreme Court.

  1. Please list your North Carolina firm’s professional memberships and national legal associations.

  1. Please list the courts in which members of your firm are authorized to practice.

  1. Please include assurances that your firm and any individual attorneys appointed to represent Council have not been disciplined by the North Carolina Bar Association or any other bar association

Please provide a list of all public clients, if any, that your firm has represented over the past five (5) years.

The successful firm (s) must provide and maintain the following minimum insurance coverage limits during the performance period required under the contract resulting from the request for proposals:

Commercial third party liability – $ 1,000,000 per event

Automobile third party liability – $ 500,000 per event

Workers’ compensation – statutory limits

Prior to commencing any work under this contract, the successful firm (s) will provide Lenoir County Schools with a Certificate of Insurance stating that the insurance required herein has been purchased. Companies must give Lenoir County schools thirty (30) days notice of cancellation, non-renewal, or any change in insurance coverage below the required minimums, including changes in the amount of the fee. blanket.

No subcontractor is allowed; a partner, lawyer or other legal representative of the winner’s firm must perform all or part of the work.

All admissible proposals meeting the eligibility criteria defined here will be evaluated by the school system.

The selection will be based on the following:

Schools in Lenoir County will select the best proposals for a final comparison exam and may contact each service agent and ask follow-up questions regarding the answers if necessary. At this point, schools in Lenoir County may request one-on-one interviews with the top finalist to allow them to clarify areas of their responses. Based on the review and evaluation process discussed in this Request for Proposal, a decision will be made regarding service awards.

  1. Waiver and / or rejection: Lenoir County Schools reserve the right to reject any proposal in whole or in part; with or without cause, and to accept proposals, if any, which, in its opinion, will be in its best interest. Schools in Lenoir County will also have the option, if no submission meets their criteria, to hire a lawyer of their choice.

  1. Public record of the proposal: The proponent acknowledges that all information contained in its proposal is public records as defined by the North Carolina State Public Records Act.

  1. Unsolicited solicitation: Any solicitation of members of the board of directors, officers or any other employee of the Lenoir County schools by the applicant may result in the refusal of consideration of his proposal.

The duration and options for renewal of the contract will be negotiated with the selected company. The initial term and any renewal term may be terminated by either party upon thirty (30) days written notice.
